ProductGeneral Warranty Provisions
Interlocking Floor Tile Full Warranty with respect to: Workmanship, quality, color, material conformance, dimensional stability, size, and suitability of adhesion of tile to adhesives if used and specifically recommended by Floor Surfaces.
Technical Support Floor Surfaces will provide telephone technical support in the event of any claims.

Limited Warranty:

  1. Floor Surfaces warrants for a period of (5) years from installation, that it's floor tile products, not including adhesive products, shall conform to the product description for such goods and are warranted to be free from defects in: Workmanship, quality, color, material conformance, dimensional stability and size.

  2. Seconds or irregular materials are sold as is without warranty as to quality in any respect.

  3. Floor Surfaces warrants for a period of (5) years from delivery, that it's floor tile products, not including adhesive products, shall be suitable for adhesion of the underside surface to adhesives specifically recommended by Floor Surfaces.

  4. The warranties set forth in this provision are exclusive and in lieu of all warranties expressed or implied, including warranties arising from course of dealing or usage or trade.

Product Suitability and Installation:

'Floor Surfaces' shall have no responsibility for suitability of goods for uses and applications contemplated by Buyer and/or others. Such determination shall be the sole responsibility of Buyer and/or others. Suggestions or recommendations made by 'Floor Surfaces' in its product literature concerning uses or applications of the goods are believed to be reliable, but 'Floor Surfaces' makes no warranty or guarantee of results to be obtained, since conditions of the use, application and installation by the buyer and others are beyond the control of 'Floor Surfaces' and will vary at every site location.

'Floor Surfaces' warranty specifically does not cover installation of floor tile products since Floor Surfaces has: (a) No control over contractors or installers, and (b) No control over the procurement of adhesives or the care and procedures by which such adhesives are used.

Claim Period and Remedies:

Written notice of any claimed defect must be received by 'Floor Surfaces' within ten years after the date of installation.

Prompt written notice shall be given to Seller of any claim of breach of warranty or otherwise relating to the goods. Should any failure to conform to these warranties under normal and proper use occur within the warranty period, Seller will supply, without charge, new goods of the same or similar color, design and grade for the defective goods or, at its option, seller may refund upon return of goods, the full purchase price not including shipping costs. Seller may require that the buyer return samples of goods for inspection by the Seller, indicating the claimed defects so that Seller may verify that defects exists. Seller will at it option, prior to a refund, require that the goods be returned to the Seller. The Seller will supply boxes, pay returning shipping cost, and be liable for reasonable repacking labor provided by the Buyer.

Limitation of Liability:
Seller shall not be liable in contract, in tort (including negligence), or otherwise for damage or loss of other property, loss of profits or revenue, loss of use of property or equipment, claims of customers of the Buyer, or for any special, indirect, incidental, or consequential damages whatsoever. Under no circumstances shall Sellers liability exceed the purchase price of the goods in respect of which damages are claimed. The obligation of 'Floor Surfaces' and Buyers sole remedy under its Limited Wear warranty is the supply of replacement flooring tiles for the failed material from regular product inventory lines, or at the option of the Seller to refund upon return of goods, the full purchase price not including shipping costs. 'Floor Surfaces' shall not be liable for labor or for any other costs incurred in the repair or replacement of flooring tiles other than to supply boxes, pay returning shipping cost, and reasonable repacking labor provided by the Buyer. 'Floor Surfaces' shall not be liable for any special, indirect, incidental or consequential damages.

The remedies provided above are the Buyers sole remedies for any failure of Seller to comply with its obligations. Correction of any nonconformity by replacement, or by refund, of the purchase price of the nonconforming goods (less allowance for use) shall constitute complete fulfillment of all the liabilities of Seller with respect thereto whether the claims of Buyer are based in contract, or tort (including negligence), or otherwise.

Exclusions:

'Floor Surfaces' flooring products warranty excludes:

  • Installation labor, adhesives, or any other installation procedures or costs incurred.
  • Colors that vary from printed illustrations or samples.
  • Exact matching of shade, color or mottling.
  • Tiles with slight color variations not detected prior to installation. All tiles must examined under standard lighting conditions for color acceptance before being installed.
  • Any expressed or implied promise made by any salesman or representative.
  • Tears, burns, cuts or damage due to improper installation, improper use or improper cleaning agents or maintenance methods.
  • Labor costs for installation of original or replacement material.
  • Sale of “Seconds”, “Off Goods” or other irregular (non-first quality) flooring materials.
  • Problems caused by moisture, hydrostatic pressure, or alkali in the subfloor.
  • Problems caused by uses, maintenance and installation that is contrary to 'Floor Surfaces' specifications, recommendations or instructions.
  • Material installed with obvious defects.
  • Damage to flooring products from high heels or spike heels.
  • Material not installed and maintained as recommended by 'Floor Surfaces'.
  • Tile used in commercial kitchens and/or areas where impregnation from cooking oils, vegetable fats, etc. is likely to occur.
  • Attack by chemicals and various substances that normally attack plastic formulations such as MEK (methyl ethyl ketone), and Acetone etc. If any particular chemicals or substances are going to be present in the environment, adequate testing should be done in advance to ensure suitability for the application.
  • Floor Surfaces ResiliaTM althought technically suitable, are not recommended for exterior applications or commercial and industrial kitchens due to wetness and oil vapor conditions, and specifically does assume any liability regarding slip resistance in either dry, wet, grease or oil vapor conditions. Further the use of Resilia tiles or any other tiles used in kitchens are clearly subject to such uncontrollable slippery conditions due to oils, oil vapors, water and soap substances. Floor Surfaces does not assume any liability for its tiles used under such conditions.
  • In some applications, such as where there is concentrated sunlight, it may be required to glue the tiles to the sub-floor.
  • Floor Surfaces does assume any liability regarding slip resistance in either dry or wet conditions. Further the use of Resilia tiles or any other tiles used in bathrooms are subject to uncontrollable slippery conditions when water and soap substances are present and Floor Surfaces does not assume any liability for its tiles used under such conditions.
  • Jack Stands:
       
      Flexible PVC floor tiles being similar hardness to rubber tires withstand a load of approximately 150 psi at room temperature.

      The tiles will be indented by floor jacks and stands. If the load is not high the marks usually disappear when the load is removed. However stands (3 leg styles) typically rest on (6) sharp points each, and if a car or engine is being supported, the sharp points will cut into the tiles.

      Given this we recommend that pads approximately 2-1/2" to 3" dia., be placed under each leg of stands to avoid such damage.

      Floor jack wheels with heavy loads will indent into the tiles, but do not usually cause damage or marks, but if the jacks are moved or rolled with load on the tiles it can cause a wave as the wheels move and can cause the interlocking edges to uninterlock as the wheels move from one tile to another.

      If tiles are damaged due to stands, we have no way to determine the load on the stands and therefore we do not guarantee our tiles for this kind of use. Our suggestion with all loads is to always place support on top of tiles to avoid damage.

      Note: The above applies to all manufacturers of flexible PVC tiles. We have heard that other tiles made from hard rigid materials such as Polypropylene can crack or break under loads as above.
